When a business deal is made between two companies is it absolutely necessary for both of them to agree to have a press release? Or can one company put it out without notifying the other?

Both party needs to agree on the press release. You dont want your new partner to send out a press release without running the content by you first right?
I think this question has an “it depends answer.” Ideally, if you are talking about a major merger or joint venture or something like that then both parties should coordinate the press releases. That’s just good for everyone involved (i.e the employees or shareholders on both sides).
But in many other cases, the business deal may be very important to one company (i.e my last company signed a big distribution/logistics contract with a company that mattered more to them than us) but not that newsworthy to the other. In those cases, one company may go it alone since only they really are seeking to make news about the transaction.
Some of the issue really comes down to being respectful of the other company rather than doing something illegal or immoral. In other words, I am certain you should tell the other company you want to announce this so they can respond (or not). There is nothing legal to stop you from saying you work with company X. That’s a factual statement. But letting them know you want to put them in your press release is just the right thing to do since it will get back to them at some point.
